Married to a Spaniard or EU citizen? The EU-family residence card explained

If you are married to — or the registered partner, child, or dependent relative of — a Spanish or EU citizen, you don't go through the ordinary immigration regime. You apply under EU free-movement rules for the Tarjeta de Familiar de Ciudadano de la Unión, and it's one of the most favourable routes Spain offers.

Who qualifies as a family member

  • Spouse, or registered <a href="/routes/pareja-de-hecho">pareja de hecho</a> (de-facto partner).
  • Children under 21 — or older if financially dependent.
  • Dependent parents or parents-in-law.
  • Other dependent relatives in defined circumstances.

The Spanish or EU citizen you're joining must be exercising their rights in Spain (living here, and generally working, self-employed, studying or self-sufficient). If you're an unmarried couple, registering your pareja de hecho first is what unlocks this card.

Why it beats the general regime

Compared with ordinary family reunification, the EU-family route is lighter on requirements: no points-based income test against your own salary, an immediate right to work, and a five-year card that leads to permanent residence. The trade-off is that it depends entirely on your relationship to the EU/Spanish citizen.

What you'll need

  • Form EX-19 and the Modelo 790 Código 012 fee.
  • Proof of the relationship (marriage certificate, or pareja de hecho registration; birth certificates for children) — legalised/apostilled and officially translated where required.
  • Proof the EU/Spanish family member is resident and exercising treaty rights.
  • Evidence you're living together / the family member can support the household.
  • Padrón, passport, and passport photos.
