Spanish nationality by residency: who qualifies and how long it takes

Spanish nationality by residency (nacionalidad por residencia) is the finish line that residency builds toward. Everyone has heard the "ten years" rule — but for a huge share of applicants the real requirement is far shorter. Here's how it actually works.

How many years you really need

The required period of continuous legal residence depends on who you are:

  • 10 years — the general rule.
  • 5 years — recognised refugees.
  • 2 years — nationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal, and Sephardic Jews.
  • 1 year — people born in Spain; those married to a Spaniard (after one year of marriage and living together); widows/widowers of Spaniards; and certain people with Spanish parents or grandparents.

Crucially, the residence must be legal, continuous and immediately before you apply — which is why getting and keeping your residency clean (and reaching Larga Duración) is the foundation.

The two exams

Unless you're from a Spanish-speaking country, most applicants sit two Instituto Cervantes tests:

  • DELE A2 — a basic Spanish-language exam (waived for nationals of Spanish-speaking countries).
  • CCSE — a short test on Spanish constitutional and sociocultural knowledge.

Can you keep your current passport?

Spain generally asks you to renounce your previous nationality — but not for nationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea and Portugal (and Sephardic Jews), who may hold dual nationality. In practice the "renunciation" for others is a formality that other countries may not enforce, but check your home country's rules.

If you're Latin American, the path is often two years' residence + the CCSE exam — not the decade most people assume.
